Case Name: Rogers v. Pima County et al.
Court and Case No.: C20046309
Injury: Serious injuries suffered by a 15 year old boy in a crosswalk adjacent to Mountain View High School in Tucson, AZ. Ms. Ealy was the driver of the vehicle that struck Talin Rogers in the crosswalk. Mrs. Ealy stated she never saw plaintiff until it was too late to avoid hitting him. The county was sued for negligent road design in failing to have traffic control devices at the crosswalk, and an excessively high speed limit.
Settlement Demand: $5,000,000
Settlement Offer: County refused to make an offer. Mrs. Ealy offered $120,000.
Jury Verdict: $9,200,000 total, holding both defendants responsible. (March 6, 2007)


Case Name: Coffey v. Desert Cardiology
Court and Case No.: C20041675
Injury: Wrongful death of Steven Coffey who died while undergoing an exercise stress test at Northwest Medical Center in Tucson. Mr. Coffey was a high risk patient who suffered a heart attack while the stress test was being conducted. Mr. Coffey’s blood pressure dropped and nitroglycerine was administered. Experts testified that as a high risk patient, he was not a good candidate for an exercise treadmill test and that nitroglycerine should not have been given to a hypotensive patient
Settlement Demand: $1,500,000.00
Settlement Offer: Dr. Goldfinger refused to participate in settlement negotiations.

Case Name: Lomen v Katakkar
Court and Case No.: C20051713
Injury: Jan Lomen, a 63 year old single woman, was referred to hematologist/oncologist Dr. Suresh Katakkar because it was discovered that she had an elevated protein in her blood when she was being worked up for hip replacement surgery. Dr. Katakkar diagnosed plaintiff with multiple myeloma, an incurable cancer, on December 31, 1997, her first visit, without doing proper and complete medical tests to verify the diagnosis. Dr. Katakkar started Ms. Lomen on treatment shortly thereafter and continued treatment for over 5 years. Ms. Lomen found out she did not have multiple myeloma in August 2003 when her employer changed insurance plans and she had to find a new doctor. A lawsuit was brought for negligent infliction of emotional distress for the 5 years of unnecessary treatment and worry about having "terminal cancer".

Case Name: Eve Retz v. University Medical Center and John Hughs, M.D.
Court and Case No.: Pima County Superior Court # C20000230.
Injury: Medical malpractice case brought by the surviving spouse of 68 year old, retired business man, Bill Retz. Mr. Retz died when the defendant doctor and hospital nursing staff failed to recognize and treat the patient's lack of oxygen following a surgery. Mr. Retz died of anoxic brain damage caused by lack of oxygen while he was being treated in the intensive care unit of University Medical Center.

Case Name: Monaco v. Health Partners of Southern Arizona and Lalitha Ramanna, M.D.
Court and Case No.: Pima County Superior Court Cause Number 315187.
Injury: 60 year old retired school custodian reported to defendant nuclear medical department for a mass red blood cell test. Through an administrative error and failure of the defendant doctor to take an adequate history, the plaintiff was injected with radioactive phosphorous (P-32). Plaintiff has a 10% chance of contracting acute leukemia in the next 6-8 years and suffers post-traumatic stress disorder.

Case Name: Hamner v. University Medical Center
Court and Case No.: Pima County Superior Court Cause Number 276643.
Injury: Wrongful death of 54 year-old totally disabled woman. Decedent had been on total social security disability for 15 years due to degenerative back condition. She died on the operating table of anesthetic complications. Survived by husband and three adult children.
